What Goes With Your Home Sale
What normally stays with the sale of
you're home?
In legal terms, real property will convey. Real property is considered to be anything that is physically attached to the house and would leave visible damage if removed. In most cases this includes: the house, land, trees, plantings, fences, decks, TV or satellite antenna, and any inside or outside fixtures including light fixtures, wall-to-wall broadloom, built-in appliances and cabinets. Everything else is personal property and is excluded from the sale of home. These items include such things as the clothes washer, dryer, refrigerator, stove, most window coverings, swimming pool chemicals and accessories, window air conditioners, etc. If you're in doubt about what stays and what goes with the sale of you house, ask. Avoid any surprises when it comes closing time.The Exception If there is particular real property in your home that you can’t bear to leave behind, either remove it before showing (and repair any damage caused by removal) or specify that it is not included in the purchase in the "Exclusions" section of the Listing Agreement. More importantly, clearly specify the exclusion in the "Not Included" section of the Purchase and Sale Agreement. Disclosure up front helps to avoid deal-killing misunderstandings.The Options Some sellers may include with the purchase: personal property that was either custom made for the home or that the seller may feel adds value for the buyer -such as custom, window treatments, bar stools, hot tub or a riding mower. Buyers on the other hand might ask for personal property not included in the purchase like garden tools, central vacuum and pool accessories. Some items like a dining room chandelier are normally considered real property. If you wish to take it with you when you move, the buyer may agree, but if your sale hinges on the leaving the chandelier, let the chandelier go!Reminder: If you're contemplating a move in the next 6 to12 months, now is the time to begin putting your plan into action, while time is still on your side.
